These General Conditions should regulate the contractual relationship between Courty & Fils, 44 rue des Petits-Champs 75002 Paris – France (RCS Paris 439 860 099) et the customer defined as the user of the site www.couteaux-courty.com .
ARTICLE 1 – ACCEPTATION OF THE GENERAL CONDITIONS
Each buyer is acknowledged about the General Conditions to let him place an order. Consequently, confirming the order on the site www.couteaux-courty.com implies complete agreement of the present General Conditions.
ARTICLE 2 – REGULATIONS
Some products sold on the site www.couteaux-courty.com are subject to the French regulation for weapons. So, the weapons and relative equipment of B, C and D category can be delivered in Metropolitan France. Check, on the site, the “weapons regulation” page. Any weapon or ammunition prohibited in Belgium will not be shipped, e.g.: knuckles, sound suppressors, slingshots…
The buyer will have to, within a maximum time of three days after placing the order, provide the proof of his age (+18) and the copies of all documents required by the French regulation; depending on the case: national identity card and/or hunting permit and/or shooting license and/or ball-trap license, with the relative validation, so that the said order is considered as receivable.
ARTICLE 3 – ORDER
On internet: www.couteaux-courty.com The contractual information are presented in French et will be subject to confirmation, relating these same information at later at the moment of the delivery. The information entered by the buyer when placing the order, appeal him: in case of mistake by the recipient when entering the address, the seller will not be held responsible for not being able to deliver the item(s).
By placing the order, the buyer declares to be acknowledged about the entire General Conditions, or according to the case, the specific conditions, and to accept the latter Condition with no restrictions. The buyer assumes he benefitted and received all necessary information to ensure the offer is matching with his needs. The buyer declares to be able to legally contract, according to the French laws, or to represent the moral or physical person for whom he’s implying himself. Unless proved otherwise, the information registered by Courty & Fils constitute a proof for all the transactions.
ARTICLE 4 – AVAILABILITY
The buyer is acknowledged of the information regarding the availability of the products when placing the order. The products are proposed for purchase in the limit of the available stock. Courty & Fils cannot be held responsible for mistakes or extraordinary modifications made by supplier. Products not available in store may be proposed anyway, but under reserve of availability from the supplier. The buyer in acknowledged by e-mail or by phone in case of unavailability of a product after the order has been placed. He’s then proposed to cancel, or to modify his initial order.
ARTICLE 5 – ONLINE CONCLUSION OF THE CONTRACT
To place the order on the site, the customer agrees the following steps of the contract:
information about the features of the product; choice of the product, depending on the case, its options and indications of the essential data regarding the customer (identification, address…); agreement of the present General Conditions; check of the elements of the order and, if needed, correcting the mistakes; payment instructions and products payment; products delivery.
The selling contract is concluded by the payment confirmation.
The customer will then receive, by e-mail, the online payment confirmation, as well as an order confirmation. He will receive a .pdf copy of the General Conditions. For the shipped products, the delivery will be done at the address indicated by the customer. According to art. 1316-1 of the Civil Code, the customer is committed to provide Courty & Fils with verified identification elements. Courty & Fils reserve itself the right to refuse any abnormal or dishonest request.
For orders shipped out of Metropolitan France and DOM-TOM, the customer is expected to be acknowledged about the regulations in the country of destination.
Courty & Fils will declines any responsibility in the case the product would not meet the requirements of the regulation in the country of destination.
ARTICL 6 – PRICES
The prices of the products are indicated in Euros, tax included. Duty free price is also indicated on the order page of these products, shipping not included. Regarding the products shipping outside of Europe and/or DOM-TOM, le price is automatically calculated as “duty free” on the billing. Customs fees/taxes, local taxes, or importation fees that may be required, are under the responsibility of the buyer. Courty & Fils invite the customers to inquire on these details (see competent local authority).
Courty & Fils reserves itself the right to modify its prices at any moment. The cost of the telecommunications to have access to the website www.couteaux-courty.com cannot imputed to Courty & Fils.
All orders, whatever the origin, must be paid in Euros.

ARTICLE 7 – PAYMENT
The payment of the purchase is done when placing the order: by check with the order form addressed to Courty & Fils, or by credit card (Visa, Eurocard, Master Card, CB). Payments done via the website www.couteaux-courty.com are secured by CIC bank’s payment system: Monetico. When the customer enters his bank data, he’s in direct link with CIC bank payment server. Therefore, there is no way for Courty & Fils to read the customer’s card number, nor to record it. All information exchanged with CIC bank are encrypted thanks to the SSL protocol and cannot be intercepted or modified. With Monetico, the buyer is ensured that Courty & Fils has the official agreement, by CIC bank, to cash transactions from internet. Once the payment is done, Monetico provides the buyer with an electronic ticket, detailing all the elements of the payment, and the result of the bank authorization (transaction accepted or cancelled).
Once the payment is confirmed by the customer, the transaction is immediately debited, after information control. In accordance with the Financial regulations, the agreement to pay by card is irrevocable. By indicating his bank information when placing the order, the customer gives Courty & Fils the permission to debit his card for the related amount. The customer confirms that he’s the legal owner of the card to be debited and that he is legally authorized to use it. In case of a mistake, or if debiting the card happens to be impossible, the purchase would be immediately aborted, and the order cancelled.
ARTICLE 8 – RIGHT OF WITHDRAWAL
According to art. 121-20 of consumption code, the customer can exercise his right of withdrawal within 14 days, without having to justify it, or to be charged for any cost, except the one for the shipping. This delay starts from the actual delivery of the product, or the acceptance of the offer in the case of a service. The right of withdrawal can be exercised by contacting Courty & Fils thanks to the dedicated form accessible on the site.
In the case the right of withdrawal would be exercised, only the price of the product(s) purchased and the shipping cost will be refunded. The customer will be charged for the shipping cost.
When returning a product, it’s critical to pack up the original case of the product, since this case is not expected to ensure the protection of the content. If not packed properly, the parcel will not be accepted.
Courty & Fils only accepts products sent back in their integrality, with their original boxing, in brand new state. Consequently, items returned uncomplete, worn out, or damaged, will not be accepted. A “normal” use of the product is determined by the regulation Loi Hamon as it could have been demonstrated in store by the seller.

ARTICLE 9 – LEGAL GUARANTEE
According with the law, Courty & Fils assumes two guarantees: of conformity, and relative with hidden defects of the product. Courty & Fils refunds the buyer or exchanges defective products or products not matching with the order. The buyer is advised he has 2 years, from the date of delivery, to notify the seller that he can choose to replace or to repair the defective product or not matching with the order; he’s exempted to bring the proof of the conformity defect of the product for a period of 24 months from the delivery, 6 months for second hand products. The customer can assert the guarantee in case of any hidden defect of the sold product, within the meaning of article 1641 of the Code Civil and, in this case, can choose to void the sale or a discounted price (article 1644 of the Code Civil).

ARTICLE 10 – COMMERCIAL GUARANTEE
In the case the product ordered by the customer is covered by the commercial guarantee, the customer will receive at latest at the moment of the delivery of the order, a document detailing the terms of the guarantee, its duration, its possible cost. However, this guarantee is void in case of damage, or unappropriated use of the product by the customer. Note that Courty & Fils cannot be responsible in the case of unappropriated installation or use of the product.
Asserting the guarantee can be done by any mean to Courty & Fils as mentioned above.
The costs and risks entailed by the return are at the charge of the customer and will be refunded in case of execution of the guarantee, on justificatory documents.
ARTICLE 11 – DELIVERY
Products are delivered at the address indicated when placing the order, and in the indicated delay. Preparing and handling of the order is not included in the indicated delay. If unusually long delay is noted, or if shipping is not feasible for availability reason, a message will be sent to the buyer. Courty & Fils can decide to fractionate the shipping. In case of a unusually long shipping delay, the customer can void the contract according to the procedures end terms detailed in Article L 138-3 of the Code De La Consommation. A customer support contact (cost of a local communication from a fix phone) is indicated in the confirmation Email, to ensure the follow up of the order.
Courty & Fils reminds that the customer becomes responsible for any risk of loss or damage at the moment he takes possession of the products. It’s up to the customer to notify the transporter for any reserve regarding the delivered product.
At the delivery, the customer must ensure the products have not been damaged during the transport.
